Hi,

Gurus - I have few questions and I need your help:

1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?

2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?

3. Is it better to efile or paper file?

4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?

I filed for my self, wife and two daughters I-485 and EAD with all documents but without I-140 recipt notice instead I enclosed evidences of the cashed check, INS online status print out and cover letter with reciept number.

My application reached on July 2 at 11:34am. No reciept yet. I called INS and representative explained my case will not be denied. If at all, INS will ask for the reciept notice.
I have my reciept notice for I-140 now.
At this point shall I wait or apply one more today with the reciept notice.

If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.

Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.

I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

I worked for an employer on h1b from oct,2005 to jun, 2007 and then for another employer from jun, 2007 till now (Aug, 2009). My I797 says my H1b is valid only till 05/2010. Since i wud complete my 5years in US only in Oct, 2010, is it possible for me to get H1 extension for another year in 05/2010 even if my employer doesn't file for GC or he starts GC now but I don't get I140 by 05/2010. How and when do I need to apply for H1B extension.

Hello Friends,

I currently reside in Nebraska. I'm in pending I-485, and its I-797C�s Received Date was in Aug, 20007, Receipt Number: LIN-xx-xxx-xxxxx. My EAD expires on this December 2010, and my AP has expired on December 2008. I re-entered US on Feb, 2010 using H1B Visa and its HIB has expired on May 2010. I�d like renew my EAD and AP. I�ve got all paper ready to file, but I�m confused about Where Service Center/Office I should file to and pay the fees to. I�d appreciate your help.
