hi,
Currently I'm working for a major software firm (10,000+ employees) as a senior software engineer. My 6-yr H1-B expires by January 2010.
I filed for PERM with PD of October 2007 in Atlanta center under EB2 category for Sr.Software engineer position. As we know it is still in PENDING status after a AUDIT request.
Now, I have received an offer for a Sr.Technical Program manager internally in my company.
What are my options now?
1. Can I withdraw my current PERM (while it is PENDING after AUDIT) and apply for a new PERM under new position? OR
2. Can I use the same PERM since I'm staying with the same company?
3. Does the company size help in any way?

no it wont coz any problem. she needs to have a valid AP and that it. She need not stamp her H1b. I did it the same away.

a compromise has been reached between Democrats and Republics for CIR.

Lets hope all those eligible for I485 get green card asap.

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.
I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.
Does it mean that I have to move over to EAD if I get the offer?
Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

Hello!
I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:
Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

People,
I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.

I have appeared for interviews in toronto. They have not looked at my pay stubs in detail. The most they would go is to check if you are still employed with the same firm. Again, this said each case is different. Stuff like Employer reputation, qualification etc., surely helps.

I filed paper based AP at Nebraska service center and got AP in 5 weeks. Pretty painless except paying them 300 for 2 pieces of paper is outrageous.

One of my close friends got RFE on I-485. He is working for the Company A, but his labour and I-140 applied in June 07 from company B as substitution. Currently his I-140 got approved. But he got query as mentioned below. Can some one send sample letter .
You must submit a currently dated letter from your intended permanent employer, describing your present job duties and position in the organization, you proffered position (if different from your current date), the date you began employment and the offered salary or wage. This letter should be in the original and signed by an executive or officer of the organization who is authorized to make or confirm an offere of permanent
employment. The letter must also indicate whether the terms and conditions of your employment-based visa petition continue to exist.
