Hello,
My priority date is October 2007. I got my I-140 denied , based on EB2, on the basis that the 5 years of education does not equate to the 6 years the USCIS believes is required for a Masters degree.
My lawyer got an education evaluation done and filed an appeal withing 30 days , in January 2008. The appeal has been pending since then.
I need advise on what to do next? Should I apply for another I-140? Can I somehow get the appeal decision expedited?

I am currently working for company A under H1B visa. Company B recently bought all of Company A�s Assets. I am still working for Company A (doing clean-up work) but will be laid off shortly (within a month). Company B offered me a similar position.
I read that since Company B bought all the assets and runs a similar business they would be considered as "successor of interest�, therefore, we would not need to file a transfer with USCIS and a simple letter would be sufficient.
How does that work exactly? Can I travel with my old visa and the letter? What happens if later on Company A is dissolved? Cancel the visa?
I think that Company B is ready to sponsor me for the Green Card. I�m not sure that they would be ready to pay for the fees for the transfer AND the green card now. I would really like to start the Green card process as soon as possible since it takes so long. I understand that it might be better to file a transfer to be on the safe side but if I can save some of the fees it would be great.

I allways have a problem with this site..every time it says my password is not valid and makes me change the password.. and the new password works only sometimes..is this a problem for me only..I am the only one..??

Do priority dates matter now?
with the deluge of applications that will be filed,will the priority dates matter anymore?
lets say someone with a priority date of Dec 2006 (EB2-ROW) applied for 485 in Feb 2007...will his case be processed before a person with a September 2005 priority date that filed in July 2007 (EB2-India)?
so other than allowing us to file the 485 the priority date has no value?

The dates are Hoax, I dont know what Nebraska is doing,

One of the stand out football players for the United States Military Academy at West Point is junior Alejandro Villanueva, a Spaniard who played high school football in Belgium. The wide receiver is also the tallest player in all of college football - 6 foot, 10 inches. Villanueva will have to serve five years in the Army after graduating and will probably be deployed to Afghanistan or Iraq. My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.

My H1 was denied the last cycle. The denial decision was posted on Nov 24th. My application was in RFE state for quite some time, hence the delay. The question that I have is, as the denial came very late, will I be able to apply for an H1B this year. We generally file all our documents on 3.31, I am wondering if I would not be eligible this year because 3.31 is not 6 months from 11.24. There is an rule that I cannot apply if there has been a denial in the recent 6 months. Please let me know if that is the case. Will I be ineligible for this year (3.2010).
I am currently in my 4th year on a L1.

Those who were able to upgrade to premium processing before Jul 2, did you get a new receipt number for the upgrade? Or was the old receipt number valid?
old one remains valid. Your status on that will indicate that the application has been upgraded to PP, and then the same reciept number will tell you about the decision

In brief, I have applied for I-485 when I was single and now priority dates are current. I need to add my spouse. Do I need to apply for I-485 for myself again? Below are the timelines.

2. I was Single.
3. Files I-140 and I-485 concurrently.
4. Schedule A expired.
5. Application moved to Eb3.
In June 2007
1.Employer B (Moved in June 2007 via H1b transfer).
Married in 2008.
April 2010.
