hello all,
My H1 extension was filed with regular processing and I got RFE too.
My office has replied to RFE and as per tracking it is delivered today.
any guess about following -
Approx. after how many days USCIS update the status with "response" received?

I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

Hi,
I got my H-1b(6th year extension) approved from VSC, within a week, using premium processing. My 140 is pending. So, I got approval for only one year.

Feel free to add more digit if you like.(LIN 07 222 58xxx) etc. If you are not EB2 india or china, please indicate (LIN 07273 xxxxx - approved on 26th August -EB1 ) , If your LIN # sequence is already list - please just list your lin # followed by a squence line..lime LIN 07 269 xxxxx - (2)

The latest processing times have been updated but not the Processing Trend Dashboard.
I believed after the USCIS Site re-design they were going to be prompt with these updates.
What is Strange in that is, the September data is showing as Zero ?!!

Hi,
My labor was denied first time through PERM(December 2005) and later after refiling, it got approve through PERM ( Applied on May 2006)
Now Can I use my first labor filing date as the priority date(Decmber 2005) or they will take the new date(May 2006).
I have I-140 Approved.

Typically, visa backlogs are reduced by issuing visas and thus removing people from the demand list. In this case, the movement is due to decreased demand � people with approved petitions on the waiting list simply aren�t applying for visas.

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas
And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply

when filling the education details in DS 157 - I gave the STD code wrong,for one of my educational institutions
You can go online and change; In case, you are unable to do it - take a print out of filled application and correct it by hand, dont worry about this.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Below is my situation;
Last project ended July 17 and am out of project since then and my last pay check was for the week of July 17. I was sent a termination letter and my employer said that he will not revoke my H1B and told me to transfer my H1B ASAP. I have been trying to do a H transfer from then on but no company is willing to do since I don't have a project and every one told to find a project first.
Finally I found a project but now employers are not willing to do a transfer saying that I don't have pay stubs for almost two and half months. A few employers are suggesting to file a new H1B.
What would be the best course of actions in my situation.

Guys,
I need some advice and your own experiences.
Right now i am with company A(EB3-I, PD:12/2001) and 485 is in progress.
I have another approved I140 with Company B in EB2 category(PD:05/2006) and i did not try to recapture my PD at that time.
My question is, if i interfile company B 140 with Company A 140 would i be able to recapture the EB3 priority date. I do not want to loose the old priority date.
Any pointers or own experiences would be helpful.

Please take couple of secs to finish this poll. No matter what was your case for interview..extension, renewal, first time..when was H1/H4 etc approved..where it was approved..etc etc..nothing matters. All that needs to be tracked is wait time.
As long as New Delhi consulate please do this and this will give an idea for wait times.

When we do Google searching for word �immigration� Google engine will present the results based on page ranking. Can we do the following:
1. Create a page in Immigration voice that indicates clearly �retrogression issues�
2. Then we �users� can try to sort of �market� it so that this page becomes most hit page, and becomes first few pages that shows up on top in Google search.
I hope I am able to express myself. Comments please.

My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.
