Those of you who have been reading this blog awhile will recall the many posts I've written regarding major problems in the system of detention for immigrants facing potential deportation. Hi,
I had submitted my I-140, I485 and my wife's I-485/I-131/I-765 together. USCIS accepted everything but the I-131 form, which they returned saying that they couldn't located the I-485 application. Now, I have the receipt number for I-485. If I send I-131 back now, can I still use the old check? The old check is endorsed but was not deposited (they returned it).
To think of it, it is not my fault that they couldn't find the I-485 though it was in the same application packet.
I will appreciate any insight.

Does not matter. I have done both in the past. Just staple them so they dont get separated.

The American Immigration Council, an organization that does great work fighting for immigrants, annually honors immigrants of achievement. This year they have selected Cambodian-born Luong Ung who has been the national spokeswoman for Campaign for a Landmine-free World. She's worked on that worthy cause for 13 years. Ms. Ung came to America as a refugee of the "Killing Fields" in her native country and has paid the goodwill back by working on a cause that few would argue is vitally important. Hi,
My kid brother (15 years old and US Citizen) lives in India with my parents. They are quite elderly now to take care of him and we were thinking of bringing him to US legally to live with us. We want to adopt him so that he can have a good lifestyle here and have no issues legally in future. Is there anyone who has gone through similar case before ? Also, I wanted to ask if there are any attorneys that specialize in cases like these ? If so please let me know and I would like to hold a consultation asap.

I'm about to start reading British native Simon Winchester's 2003 bestseller Krakatoa: The Day the World Exploded about the massive Indonesian volcano. I've always had a fascination with natural disasters all the way back to writing a junior high school research paper on hurricanes when I was growing up in Miami. Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.
1 ) we applied for COS from H4 to H1 By Company A by premium processing.
2 ) Company B H1B from H4 is also under process.
Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.

Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

You cannot apply for I-485 unless I-140 is approved as EB1 is purely based on I-140 not labor.
