1500 H-1Bs were claimed in the last week and just over 20,000 remain for the fiscal year. Based on a four week rolling average (1175), I am projecting the target will be exhausted in 17 weeks which will be February 23, 2011. Previously, I had been projecting March, but the overall usage of H-1Bs has been somewhat busier in the last month than in previous months. My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).

Please help me with info on these questions?


1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

I am currently on H1B and in the process of leaving my current employer XYZ Inc. I also have an EAD that I haven't used yet but plan to use going forward. I understand that XYZ will and is rather obligated to notify USCIS of termination of my H1B employment by virtue of which, USICS will take steps to revoke the H1B petition. That being said,

1. Will I (beneficiary) and / or XYZ (petitioner) will receive a notice saying my H1B petition has been revoked?

2. Will it help in any shape or form if I were to fill an (back dated) I-9 form with XYZ indicating that I was already on EAD with XYZ before my termination? In this case, is XYZ still obligated to notify USCIS of termination of my H1B employment?

3. What constitutes a "bona fide termination" and is this even applicable in my case? Should I have a formal resignation letter in place for audit / RFE purposes down the road, if any?

Hello,

I am currently working on H1b visa (stamped & valid till Feb 2011). My I-485 is pending (EB3, India). However, I have a need to stay on H1-B status.

If I find a new job/employer who files for an H1-B transfer:

1. Can I travel internationally immediately after getting the receipt notice? I will continue to work for my old employer till I get back from vacation.

2. In the same trip, I plan to get married and get my spouse on a H4 visa. Will getting new H4 visa be an issue in such a case?

3. Any issues at POE?

This reporter has got it right. The U.S. is obsessed with importing poverty from poor non-assimilated immigrants (mostly illegal) and shunning high-skilled immigrants who assimilate and increase the country's living standards. Status: Labor & I-140 approved

EB2: Labor got approved November 2009.

I'm trying to file 1-140 amendment with EB3 priority date. Currently i'm thinking of going with Sheela Murthy/Rajiv Khanna,

Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... But what are the chances really? especially with new scandals beginning to take all the headlines. This is really frustrating and unfortunate. Lets see how the day goes.

I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.

If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

This is purely my opinion and may not be the best legal advice. If I were in the same situation, I would go by the EB type (EB2 first) and then by the priority dates. Whichever one is higher, I would apply both in that classification. If both I-140's are EB3 and same priority dates, I would go with the one with better job security (stable employer and job) and keep the other I-140 as backup. In this day and age of corporate acquisitions, mergers and bankruptcies and USCIS backlogs, you want to use the option with the least risk.
